Innocence on Trial: The Dark Side of The POCSO Act

When protection of children turns into a witch hunt against consent young adults, innocence is put on trial.

India passed the Protection of Children from Sexual Offences (POCSO) Act in 2012 with the intention of preventing sexual abuse of minors under the age of 18. For persons under the age of 18, this act makes both consenting and non-consensual sexual activity illegal. To ensure justice, it calls for severe punishments, kid-friendly court procedures, and quick trials.

This act recognizes sexual harassment to be non-consensual fondling, forcing any child to expose themselves or exposing themselves to a child and much more. The maximum punishment under this act is a death penalty which makes it one of the harshest and strictest provisions in the Indian legal system.

POCSO is a gender neutral law i.e. both male and female children are considered victims under this law. The POCSO act has sometimes been misused to target minor consensual relationships.

Adolescents engaged in consensual romantic relationships can be prosecuted under the act, leading to severe legal consequences despite mutual consent. Parents or guardians occasionally use the POCSO act as a tool to exert control over their children's relationships. In cases where parents disapprove of a relationship, they may file a complaint under POCSO to separate the couple.

This not only criminalises normal adolescent behaviour but also undermines the autonomy and agency of young people. The legal system often fails to differentiate between consensual teenage relationships and actual exploitation, resulting in criminal records and social stigma for minors.

The misuse of this act can have far-reaching consequences, affecting not only the accused but also the integrity of the judicial system and the true victims of sexual offences.

False charges have the power to destroy innocent people's lives and put them in financial, social, and emotional hardship. A person's life and career may be negatively impacted for a long time by the stigma associated with being accused of a sexual offence.

Not to mention being involved in legal proceedings can cause significant stress and anxiety for teenagers. The stigma of being labelled as criminals or sexual offenders can lead to long-term emotional trauma.

Real victims' access to justice is impeded by the flood of fake cases that overwhelm the legal system. Fake cases divert legal and judicial resources from genuine cases which undermines the effectiveness of the law.

The public may become skeptical of actual cases of child sexual abuse as a result of the act's misuse. Real victims may be discouraged from coming forward and demanding justice as a result of this breakdown of confidence.

To counter this issue, a section addressing the issue of teens having consenting sexual relationships with one another around the same age might be introduced. This kind of clause is commonly known as the Romeo and Juliet clause. This provision is intended to shield young people who consent to sexual activity from prosecution and severe punishment when the parties are close in age, usually within a few years of one another, and one or both are under the legal consenting age.

In conclusion, the POCSO Act is still a vital instrument in the fight against child sexual abuse in India, but its misuse poses a serious problem that must be resolve promptly. The integrity of the act can be preserved by enforcing stricter scrutiny, holding false accusations accountable, and increasing public awareness. Ensuring that the POCSO Act serves its intended purpose without being exploited is essential for the protection of children and the delivery of justice.
